1. GENERAL PROVISIONS
This privacy and personal data protection policy determines the procedure for obtaining, storing, processing and using of information obtained in the course of using FLOWERS-DELIVERY.COM.UA (hereinafter referred to as the Website).
Online shop LYSTVA (FLOWERS-DELIVERY.COM.UA) bears responsibility for preserving the right of every visitor of the Website to personal data confidentiality and takes the latest technical and organizational measures to ensure a high level of processed personal data protection from unauthorized access.

Public sources of personal data – directories, address books, registers, lists, catalogs, other systematized collections of open information that contain personal data placed and published with the knowledge of the personal data subject.
Personal data processing – any action or a set of actions, such as personal data collection, registration, accumulation, storage, adaptation, modification, renewal, use and distribution (distribution, sale, transfer), depersonalization, destruction, including the use of information (automated) systems.
The User of the Website (Buyer/Customer/Consumer) is a personal data subject. An individual who visits the Website to purchase, order products/services or who intends to purchase or order products and whose personal data is processed. Such an individual must have full legal capacity. LYSTVA (FLOWERS-DELIVERY.COM.UA) cannot collect and process information from an individual under the age of 18. Consent to the personal data processing of minor persons must be given by the legal representatives of such persons.
Consent of the personal data subject is any voluntary expression of will of an individual to grant permission for his/her personal data processing in accordance with the stated purpose of personal data processing.
User account is information of the User provided by him/her when filling in the fields of the Website in the course of registration or ordering of products on the Website, which enable to unambiguously identify the User in the process of using the Website. The User account is created by the User in the course of registration on the Website. To access his/her Account, the User applies the e-mail address and password provided by him in the course of registration.
Personal data depersonalization – removal of information that enables to directly or indirectly identify a person.
Responsible person – a person designated by the owner or personal data administrator, who organizes the work connected with personal data protection in the course of processing. The responsible person informs and advises the personal data owner or controller on compliance with the legislation on personal data protection.
3. THE PURPOSE OF USER’S PERSONAL DATA COLLECTION AND PROCESSING
3.1. The purpose of personal data processing in the system is storage and servicing of counterparty data in accordance with Articles 6, 7 of the Law of Ukraine On Personal Data Protection.
3.2. The User’s Personal Data may be used by the Administration of LYSTVA (FLOWERS-DELIVERY.COM.UA) to ensure implementation of civil relations concluded via the Website: FLOWERS-DELIVERY.COM.UA – provision/receipt and performance of payments for purchased goods/services in accordance with the Tax Code of Ukraine, the Law of Ukraine On Accounting and Financial Reporting in Ukraine, as well as:
registration and authorization of the User on the Website;
provision of the User with access to personalized resources of the Website;
creation of an account for purchases, if the User has agreed to create an account;
provision of the User with effective customer and technical support in case of problems related to the use of the Website;
making and placing of orders for goods and services;
fulfillment of terms and conditions of the remote sales contract by the Seller;
delivery of goods ordered by the User;
establishment of feedback with the User, including sending messages, inquiries regarding the use of the Website, processing of inquiries, orders, requests from the User;
determination of User’s location to ensure security and to prevent fraud;
confirmation of authenticity and completeness of personal data provided by the User;
processing and receipt of payments, confirmation of tax or tax benefits by the User;
marketing goals;
analysis of usability of the Website.
3.3. If the User agrees to receive information about new products and special offers, LYSTVA (FLOWERS-DELIVERY.COM.UA) processes his or her data to send commercial (advertising) information to him or her, for example, about current loyalty programs, promotions, special offers or sales, etc.
3.4. Personal data is processed openly and transparently with the use of means and in the way that meets intended purposes of such processing.
3.5. In case of replacement of the intended purpose of personal data processing by a new purpose, incompatible with the previous one, for further data processing the personal data owner must obtain consent from the personal data subject to process his or her data in accordance with the changed purpose, unless otherwise provided by current legislation of Ukraine.
4. COMPOSITION OF PERSONAL DATA TO BE PROCESSED
4.1. LYSTVA (FLOWERS-DELIVERY.COM.UA) processes certain personal data, depending on the purpose of processing, which, in general, will be as follows:

If the Buyer terminates the agreement and returns the goods of improper quality or LYSTVA (FLOWERS-DELIVERY.COM.UA) satisfies his or her complaint about the return of goods of improper quality and refund of the payment made by the Buyer, the Buyer shall indicate the appropriate bank account number to which LYSTVA (FLOWERS-DELIVERY.COM.UA) can transfer the refundable payment.
5. LEGAL BASES FOR DATA PROCESSING
5.1. To ensure protection of User’s personal data, this Privacy Policy has been developed by LYSTVA (FLOWERS-DELIVERY.COM.UA) in view of the provisions of Ukrainian legislation, in particular: the Law of Ukraine On Personal Data Protection, the Law of Ukraine On E-Commerce, the Law of Ukraine On Information and other regulations.
5.2. The administration of LYSTVA (FLOWERS-DELIVERY.COM.UA) processes the User’s personal data only by his or her consent. When placing an order (acceptance of the Public Agreement by performing the actions specified in item 7.1 of the Public Agreement), the User agrees to the Privacy Policy and agrees to personal data processing.
5.3. Consent to processing of personal data may be selected by clicking the appropriate box in the “I agree to the terms and conditions of the Privacy Policy” when making an order on the Website.
5.4. Consent to personal data processing is completely voluntary.
5.5. LYSTVA (FLOWERS-DELIVERY.COM.UA) does not verify the accuracy of personal information provided by the User and does not control its relevance. LYSTVA (FLOWERS-DELIVERY.COM.UA) assumes that the User provides reliable information and keeps this information up to date. The User (Buyer/Consumer) bears all responsibility, as well as possible consequences for provision of unreliable, inaccurate, incomplete, erroneous or irrelevant information.
5.6. The processing of personal data on racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, as well as data related to health or sexual life (special categories of data) is prohibited.
5.7. User’s personal data is processed without limitation of term, in any lawful way, including in personal data information systems with the use of automation means or without.
5.8. The Privacy Policy is also mandatory for the Seller’s responsible person and employees who directly process and/or have access to personal data in connection with the performance of their official duties.
6. USER’S RIGHTS IN CONNECTION WITH PERSONAL DATA TRANSFER AND PROCESSING
6.1. In connection with the personal data processing, the User (personal data subject) has the right to:
know about the sources of his or her personal data collection, location, the purpose of personal data processing, location or place of residence (stay) of the personal data owner or administrator or provide respective instructions to obtain this information by authorized persons, except for cases specified by current legislation of Ukraine;
receive information on the conditions for granting access to personal data, in particular information on third parties to whom his or her personal data is transferred;
access to his or her personal data;
receive within 30 calendar days from the date of receipt of the request by LYSTVA (FLOWERS-DELIVERY.COM.UA), except for cases specified by current legislation of Ukraine, a reply as to whether his or her personal data is processed, and receive the content of such personal data;
make a reasoned request to the personal data owner with a refusal to process his or her personal data;
make a reasoned request to change or destroy his or her personal data by any personal data owner and administrator, if this data is processed illegally or inaccurate.
revoke his or her consent to personal data collection and processing at any time without giving reasons.The revocation of consent will not affect any previous activities.
personal data protection from unlawful processing and accidental loss, destruction, damage due to intentional concealment, non-provision or late provision, and protection from provision of information that is inaccurate or discredits honor, dignity and business reputation of an individual;
file claims on personal data processing to the authorized bodies or to the court;
apply legal remedies in case of violation of the legislation on personal data protection;
make reservations as regards restriction of the right to process his or her personal data while giving consent;
revoke consent to personal data processing;
know an automatic personal data processing mechanism;

6.2. The administration of LYSTVA (FLOWERS-DELIVERY.COM.UA) is obliged to inform the User on the actions performed within 1 (one) calendar month from the date of receipt.
7. PERSONAL DATA STORAGE PERIOD
7.1. The validity of consent to personal data processing is unlimited. In any case, the duration of personal data storage will depend on the purposes and goal of processing specified in this Privacy Policy, but not more than 10 years.
7.2. The administration of LYSTVA (FLOWERS-DELIVERY.COM.UA) keeps the User’s data until deletion of the User’s account from the Website. The User’s account may be deleted at his or her request, and in case of revocation of User’s consent to personal data processing, refusal to process personal data or request for data deletion.
7.3. The systems of LYSTVA (FLOWERS-DELIVERY.COM.UA) will store only archival information about storage of data, for example, on transactions, any claims that the User may have, in particular during the warranty period established by normative legal acts or in connection with the legislation governing the activity of LYSTVA (FLOWERS-DELIVERY.COM.UA).
7.4. After the User (personal data subject) ceases to be a User of the Website by deleting his or her account at the Website, his or her personal data is also automatically deleted.

9. POWER OF ATTORNEY FOR PERSONAL DATA PROCESSING
9.1. LYSTVA (FLOWERS-DELIVERY.COM.UA) may entrust personal data processing to business partners if required for transactions, such as preparation of goods ordered by the User, and for sending of goods or transmission of commercial information (the latter applies to the Users who have agreed to receive commercial information), or for other purposes, the achievement of which is required for the proper execution of User’s orders.
9.2. User’s personal data may be transferred to the authorized public bodies of Ukraine only on the grounds and in the manner prescribed by current legislation of Ukraine.
9.3. The User agrees that the administration of the Website has the right to transfer personal data to third parties, in particular, courier services, postal organizations, telecommunications operators, solely for the purpose of execution of the User’s order placed on the Online Flower Shop Website, including delivery of goods.

9. POWER OF ATTORNEY FOR PERSONAL DATA PROCESSING
9.1. LYSTVA (FLOWERS-DELIVERY.COM.UA) may entrust personal data processing to business partners if required for transactions, such as preparation of goods ordered by the User, and for sending of goods or transmission of commercial information (the latter applies to the Users who have agreed to receive commercial information), or for other purposes, the achievement of which is required for the proper execution of User’s orders.
